Information about the Bonus Offer and how to claim (including on the Website or Point of Sale) forms part of these Terms and Conditions.
  2. 2 A person is deemed to have accepted these Terms and Conditions by submitting a product registration. No other terms or conditions (including any terms or conditions from any Authorised Retailer) shall apply.
  3. 3 No employee, agent or representative of the Promoter is authorised to make guarantees, warranties or representations in addition to, or contrary to, these Terms and Conditions.
  4. 4 The Promoter reserves the right to exclude a Bonus Claim made by employees and family members, of the Promoter, Authorised Retailer or any third parties involved in administering a Bonus Offer where the Promoter reasonably considers that the Eligible Purchase used to submit a Bonus Claim has been made using any employee or staff discount that may be available to that person.
  5. 5 The person submitting a Bonus Claim represents and warrants that all information provided is true, correct and accurate. Any misrepresentation, non-compliance with these terms and conditions, fraudulent activity or false information supplied in connection with a Bonus Claim will immediately disqualify the Bonus Claim and that person may be ineligible for any future Bonus Claims (in the Promoter’s absolute discretion). Any Bonus Claims submitted by a person who is suspected of tampering or interfering with the bonus claim process will be immediately disqualified and that person may be ineligible for any future Bonus Claims (in the Promoter’s absolute discretion).

  7. 7 Unless there is a defect with the Eligible Product, if the Eligible Product is returned to the Authorised Retailer, the corresponding Bonus Claim will become invalid. Where the Promoter reasonably suspects that an Eligible Product has been returned, the Promoter may suspend the Bonus Claim, and delay issuing any egift card, while it makes enquiries. This may include asking the Eligible Person for further information or verifying the Eligible Purchase with the Authorised Retailer. If the Promoter reasonably determines that an Eligible Product has been returned, the Promoter may, to the extent permitted by law: (a) reject the Bonus Claim; (b) cancel any egift card issued for that Bonus Claim that has not been activated or transferred; (c) require the Eligible Person to repay the value of any egift card issued for that Bonus Claim that has been activated or transferred; and/or (d) disqualify that person from future claims. If the Promoter is unable to provide the specific bonus item, the Promoter will instead make available to an Eligible Person the choice of waiting until replenishment stock of the specific bonus item becomes available or receiving alternative product(s)/item(s) of similar style or similar value (in the Promoter’s absolute discretion) by way of substitution.
  11. 11 The time taken to verify a Bonus Claim, the availability of a Bonus Offer and the date for receiving delivery of a Bonus Offer may all be impacted due to reasons outside the control of the Promoter and without notice to an Eligible Person.
  12. 12 There is no fee charged to make a Bonus Claim other than the cost of purchasing an Eligible Product and accessing the Internet to submit the claim.
  13. 13 If a Bonus Offer cannot run as planned for any reason beyond the Promoter's control (for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, a pandemic, public health orders and the like), the Promoter may end, change, suspend or cancel any Eligible Product, any Bonus Offer, the Purchase Period or any other conditions relating to the Bonus Offer or disqualify affected Bonus Claims / Claimants.
  14. 14 If a Bonus Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties or electronic tampering or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Person, or (b) to modify, suspend, terminate or cancel the bonus offer, as appropriate.
  15. 15 The Promoter takes no responsibility for any technical malfunctions or problems with internet or network congestion, problems with transmission of entries and / or emails over the internet, acts in violation of these terms and conditions, acts in a disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person.
  16. 16 Any taxes which may be payable as a consequence of an Eligible Person receiving a Bonus Offer are the sole responsibility of the Eligible Person.
  17. 17 If any dispute arises between the Promoter and any person submitting a Bonus Claim concerning any matter related to these Terms and Conditions or the registration/bonus process, the Promoter will take reasonable steps to consider that person’s point of view, considering any facts or evidence put forward, and to respond fairly and within a reasonable time. In all other respects, the Promoter’s decision is final and no correspondence will be entered into.
  18. 18 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or any other implied warranties that are incapable of being excluded (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of any Bonus Claim.
